END-USER LICENSE AGREEMENT
This Agreement (“Agreement'') is made and entered into simultaneously with the execution of the equipment purchase agreement (“Equipment Agreement”) (“Effective Date”), by and between Shina Systems Ltd. (“Shina”) and Customer (defined in the Equipment Agreement).
GRANT OF LICENSE. Subject to the terms hereof, Shina Systems Ltd. or an affiliate thereof (“Shina”) grants to Customer a limited, personal, nonexclusive, nontransferable, nonsublicensable license to use, in binary executable form only, the specific Shina product (the “Product”) embedded in a dedicated machine on which the Product is installed (“Equipment”) and purchased under the Equipment Agreement, only for Customer internal use, in accordance with the documentation that accompanies the Product.
